NOTICE OF SALE BY SUBSTANTIVE TRUSTEE 235 Solar Street Bristol, Virginia 24201 WHEREAS, Thomas W. Covington (“Grantor”), by Purchase of Money Indenture of Trust (the “Indenture”) dated June 1, 2012 and registered under Instrument Number 120000997 in the office of the Clerk of the Circuit Court of the City of Bristol, Virginia, conveyed to Elizabeth Smith Jones, Trustee, the real estate described herein (the “Real Estate”) for guarantee payment of a certain promissory note (the “Note”) described in the Indenture, and payable to Johnny C. Barker and Barbara L. Barker (the “holders” or “beneficiaries”) by Thomas W. Covington (“Borrower”); and WHEREAS Mark M. Lawson was appointed as Alternate Trustee of said Trust Deed on May 26, 2022, by Deed registered June 1, 2022 at the aforementioned Clerk’s Office under Deed Number 220001135; and WHEREAS there has been default in the payment of the note secured by the deed of trust and the beneficiaries have asked the substitute trustee to declare that all debts and obligations secured by the deed of trust are payable; NOW, THEREFORE, the Substitute Trustee HEREBY GIVE NOTICE that he will offer for sale the immovable property described below at public auction on 28th September 2022 at 10:00 a.m. at the front door of Bristol Courthouse , Va. at 497 Cumberland St. , Bristol, Va. 24201, to the last, highest and highest bidder FOR MONEY AND SUBJECT HOWEVER TO SUCH CHARGES, EASEMENTS, LEASES, OBJECTIONS, CONDITIONS, RESTRICTIONS, EXTERNAL TRANSPORTATION, CITY, COUNTY OR COUNTY TAXES UNPAID STATUS WHICH MAY BE A LIEN AGAINST SUCH REAL PROPERTY (current and overdue), and PRIORITY TAX LIGNES (if any) AS THE RECORD MAY APPEAR. Real Property is all such parcels or parcels of land, situated, located and being within the City of Bristol, Virginia and being more particularly bounded and described as follows: Parcel 1: Commencing at a point on the east side of Solar Street 42 feet north of the north corner of a lot of land formerly owned by Annie D. Adams and conveyed to her by Martha Ann Greer Peters and her husband by deed dated August 3, 1903, said deed of registration in Deed Book 14, page 459; thence northerly with Solar Street 40 feet to a picket; thence easterly parallel to said Annie D. Adams lot 165 feet to a driveway; thence in a southerly direction with the said driveway for 40 feet to a post; thence in a westerly direction for 165 feet to the point of commencement, the latter being the lot of land on which a residence is situated. Parcel 2: This lot fronting 35 feet on Solar Street and returning between parallel lines of 165 feet to a driveway, and being bounded on the north by the lot described above, and 7 feet north by the lot of land formerly owned by Annie D. Adams above mentioned. And being the same property conveyed to Johnny C. Barker and his wife, Barbara L. Barker, by deed dated August 17, 1992, of Pauline Noe, widow, registered in the office of the Clerk of the Circuit Court of the City of Bristol , Virginia in Deed Book 297, page 313. The property described above is commonly known as 235 Solar Street, Bristol, Virginia with tax card number 27,110 3. The real property and improvements thereto , if any, will be sold as is without warranty. or representations of any kind. Said sale may be postponed to a later date by oral announcement at the time and place of the published sale or canceled without further written notice or publication. The Alternate Trustee reserves the right to take or accept the next highest or best bid at such sale if the last and highest bidder fails or refuses to comply with the terms of the sale for any reason. it would be. In such event, the Substitute Trustee also reserves the right to reopen the auction or re-post and sell said property at my option. The Beneficiary may become the purchaser during the sale. The sale will be made without commitment or warranty as to title, possession or encumbrances. A deposit from the bidder of up to ten percent (10%) of the winning bid may be required. Additional conditions may be announced at the time of sale. The Substitute Agent reserves the right to conduct the sale by or through its agents or agents acting for or on its behalf, including the use of an auctioneer. Sale is subject to post-sale confirmation that the borrower has not filed for protection under the United States Bankruptcy Code prior to the sale as well as post-sale confirmation and audit the status of the loan with the loan servicer, including but not limited to determining whether the borrower has entered into a repayment agreement, reinstated or repaid the loan prior to the sale. In such event, the sale shall be null and void and Buyer’s sole remedy, at law or in equity, shall be the refund of Buyer’s deposit without interest.
